Terms and Conditions

Applicable to all transport services provided by Piano Shift

1. Scope

These General Terms and Conditions (GTC) apply to all transport services provided by TRADEMAX SOLUTIONS GmbH (hereinafter "Piano Shift" or "we"). By commissioning a transport, the client (hereinafter "Customer") accepts these GTC.

Deviating conditions of the Customer shall only apply if expressly acknowledged by us in writing.

2. Contract Formation

The presentation of our services on the website does not constitute a binding offer. By submitting a transport request via our online form, the Customer makes a non-binding inquiry. A contract is only concluded upon our written order confirmation (via email).

3. Pricing and Payment

All prices displayed on the website are non-binding estimates. The binding price is determined in the individual quote or order confirmation. All prices include statutory VAT.

Unless otherwise agreed, payment is due upon delivery of the instrument at the destination. We accept cash payment and bank transfer.

4. Right of Withdrawal

Consumers within the meaning of the Austrian Consumer Protection Act (KSchG) have the right to withdraw from distance contracts within fourteen (14) days without giving any reason. The withdrawal period begins on the day the contract is concluded.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by means of a clear statement (e.g., by email to info@piano-shift.com).

The right of withdrawal expires for services if the service has been fully performed and the performance of the service began only after the consumer gave their express consent.

5. Scope of Services

Our scope of services includes the professional transport of upright pianos, grand pianos, digital pianos, and related keyboard instruments. The exact scope of services is defined in the respective order confirmation.

Additional services such as tuning, storage, or disposal are not included in standard transport and must be agreed upon separately.

6. Transport Conditions

The Customer is obliged to provide all transport-relevant information truthfully when placing the order, in particular:

  • Type and weight of the instrument
  • Access conditions at pickup and delivery location (floor, elevator, stairway width)
  • Special obstacles (narrow passages, steps, no elevator)
  • Parking availability for the transport vehicle

Incorrect or incomplete information may result in additional costs, which will be charged to the Customer.

7. Liability and Insurance

Piano Shift is liable for damage to transported goods caused by our employees or agents. All transports are covered by our commercial liability insurance.

Pre-existing damage to the instrument must be documented by the Customer and communicated to us before transport. Any transport damage must be reported to us in writing immediately, but no later than 7 days after delivery.

Liability for slight negligence — excluding personal injury — is limited in amount to the value of the transported instrument.

8. Data Protection

Information on the processing of personal data can be found in our privacy policy.

9. Applicable Law and Jurisdiction

Austrian law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods. For disputes with consumers, the jurisdiction pursuant to § 14 KSchG (consumer's domicile, habitual residence, or place of employment) shall apply.

For disputes with businesses, the competent court at the registered office of Piano Shift shall have jurisdiction.

10. Severability

Should any provision of these GTC be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that most closely reflects the economic purpose of the invalid provision.

11. Final Provisions

Amendments and additions to these GTC must be made in writing. This also applies to the waiver of this written form requirement.
